Terms of Service

These Terms of Service ("Terms") govern your use of KartInsightsPro (the "Service"), operated by Indiana Ventures, LLC ("we", "us", or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

KartInsightsPro lets you log 2-stroke kart stints and telemetry, view data analysis (laps, sectors, turns, comparisons, and ideal laps), watch your on-board video with a synced telemetry overlay (with optional cloud backup), export and optionally share lap clips with the telemetry overlay burned in, and receive AI-assisted analysis and coaching insights. The Service is provided on an ongoing basis and may change over time.

2. Accounts and eligibility

You sign in with Google and are responsible for the activity under your account and for keeping your Google account secure. You must provide accurate information and be old enough to form a binding contract in your jurisdiction (and at least 13). Your data is organized into teams; you are responsible for who you invite to your team and what they can see.

3. Your content

You retain ownership of the stints, feedback, telemetry, and any video you submit ("Your Content"). You grant us a limited license to host, process, and display Your Content solely to operate and improve the Service for you and your team, including sending relevant data (and, where you have backed up a video, still frames from it) to our AI provider to generate responses. You represent that you have the rights to submit Your Content.

If you create a public lap-clip share, you instruct us to make that exported clip publicly accessible to anyone with the link, and you grant us the license needed to host and serve it for that purpose until you revoke the share. You are responsible for what you choose to share publicly and represent that you have the rights to do so.

4. AI output and no professional advice

The Service's analysis, recommendations, and chat responses are generated in part by automated systems and are provided for informational purposes only. They may be inaccurate, incomplete, or unsuitable for your situation and are not professional engineering, mechanical, or safety advice. You are solely responsible for any tuning, setup, or other decisions you make. Always exercise independent judgment and follow safe practices, manufacturer guidance, and applicable rules when working on or operating a kart or engine.

5. Acceptable use

You agree not to:

• use the Service in violation of any law or the rights of others;
• upload content you do not have the right to upload, or that is malicious;
• attempt to access data belonging to other teams or accounts;
• disrupt, overload, reverse engineer, or probe the Service or its infrastructure, except as permitted by law;
• use the Service to build a competing product from our data or models.

6. Intellectual property

The Service, including its software, design, and content (excluding Your Content), is owned by us or our licensors and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY OUTPUT WILL BE ACCURATE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INDIANA VENTURES, LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD 100.

9. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses arising from Your Content, your use of the Service, or your violation of these Terms.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.

11. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the state and federal courts located in California, to the extent permitted by law.

12. Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date above, and your continued use of the Service after changes take effect constitutes acceptance.
